Is cold email legal in the United States?

Yes. CAN-SPAM does not require consent before you email a business contact. It does require accurate header and sender information, a subject line that is not deceptive, identification of the message as commercial, a valid physical postal address, a clear way to opt out, and opt-outs honoured within 10 business days. Penalties can exceed $50,000 per non-compliant email, and the company being promoted is liable as well as whoever sent it, so we build every requirement into the templates and suppression process from day one.

Do US state privacy laws like California's CPRA affect B2B cold email?

They can. California's B2B contact exemption ended in 2023, so if your company meets CPRA thresholds, business contact data about California residents is in scope for notice and deletion rights. In practice that means honouring deletion and opt-out requests across every tool, sourcing data from vendors that provide notice, and keeping records.
